RND STABLES, LLC & ROCKING RMB EQUINE SERVICES, LLC LIABILITY RELEASE WAIVER

THIS FORM MUST BE COMPLETED BY AND FOR EACH RIDER

HORSE RIDING AGREEMENT AND LIABILITY RELEASE FORM FOR INDIVIDUALS RIDING HORSES AT RND STABLES AND ROCKING RMB EQUINE SERVICES, hereinafter collectively referred to as “RND/RMB”.

THIS DOCUMENT AFFECTS YOUR RIGHTS IN THE EVENT OF INJURY — PLEASE READ CAREFULLY BEFORE SIGNING. SERIOUS INJURY MAY RESULT FROM YOUR PARTICIPATION IN THIS ACTIVITY.

RND/RMB does not guarantee your safety or that of your horse. It is hereby agreed to as follows:

AGREEMENT OF RIDERS AND AGREEMENT PURPOSE

The following listed individual is hereinafter known as the “RIDER,” and the parents or legal guardians thereof if a minor, do hereby voluntarily request and agree to participate in horse riding at this Facility. The RIDER will ride his/her own horse or one borrowed or leased by the RIDER’S own arrangement, today and on all future dates:

RIDER desires to engage in equine activities sponsored by, or in which RIDER will be using an equine, tack, equipment, facilities, or premises furnished by RND/RMB.

RIDER understands there are risks in equine activities: that all horse-related activities are inherently dangerous, and agrees to comply with Oregon’s Equine Inherent Risk Law (ORS 30.687–30.697), which limits liability for providers of equine activities and services.

As a condition of participating in or viewing equine activities, RIDER (individually and for his/her minor children, executors, and heirs) waives the right to bring suit and releases RND/RMB, and RND/RMB’s administrators, agents, officers, directors, employees, predecessors, successors-in-interest, and any other persons or entities affiliated with RND/RMB, from any and all manner of actions, suits, claims for relief, demands, damages, and any other obligations — known or unknown, suspected or unsuspected, in law or equity, direct or indirect, now or in the future — for any injury or death arising out of or connected in any way with riding, training, grooming, or handling an equine.

RIDER agrees that by using RND/RMB’s facilities, including barns, arenas, trails, jumps, tack, and horses, he/she is participating in a dangerous sport and will be responsible for the safety of themselves, their children, and any guests in their party.

RIDER understands that RND/RMB requires safety helmets and boots with heels to be worn by all riders under 18, and by all riders regardless of age while jumping.

RIDER acknowledges that equine activities can be dangerous, even with reasonable care taken by RND/RMB. Due to their size and unpredictable nature, horses can react unexpectedly. Personal property may also be misplaced or damaged for a variety of reasons.

RIDER further agrees that any guests or family members RIDER brings onto the property shall be RIDER’S responsibility. RIDER assumes full responsibility for ensuring that any guest engaging in equine activities or riding signs this liability release form. RIDER agrees to secure these signatures and provide the signed releases to RND/RMB in a timely manner.

RIDER also agrees to indemnify RND/RMB and/or the released parties for any and all costs incurred in defense of any claim brought against RND/RMB or third-party guests of RIDER — whether the claim arises on or off the premises — including reasonable attorneys’ fees and costs, if applicable.

This release contains the entire agreement between the parties and the terms of this release are contractual, not a mere recital.

THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS IN THE EVENT OF INJURY.

RIDER or PARENT/GUARDIAN has read, understood, and agrees to this release.
